What Are Felony DWI Offenses?
In the state of Texas, there are four types of crimes that can be considered as felony DWI offenses. If you or a loved one was arrested for any of the following offenses, you need to immediately contact a Sugar Land DWI attorney at Stornello Law Firm, P.C..
DWI Third: Two convictions for drunk driving means that a third will incur enhanced penalties. If 10 years have passed from the date of the most recent DWI conviction, your arrest may be considered a Class B misdemeanor charge, but if this third charge occurred within 10 years of your last arrest, you could be subjected to prison time and steep fines.
Intoxication Assault: Intoxication assault is defined under Texas Penal Code §49.07 and can be charged against someone who acted in a negligent manner that resulted in serious bodily injury to another person. This is a felony offense that could potentially result in prison time, fines and probation.
Intoxication Manslaughter: This is the most serious type of DWI offense that you could receive. Intoxication manslaughter is the act of negligently operating a vehicle under the influence of alcohol that results in the death of another person.
DWI with a Minor Passenger: If a child under the age of 15 was in the vehicle at the time of the accident or arrest, you could be charged with a DWI with a child passenger. This offense is outlined in the Texas Penal Code §49.045.
